Terms of Service

1. Acceptance of Terms

By accessing or using the Booki platform ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Booki is a social scorekeeping and record-keeping platform designed for informal groups of friends. The App allows:

  • Organizers to create groups, invite members, track picks and predictions, and manage balances
  • Members to join groups, make picks on sporting events, and view their activity history

Booki is a tool for tracking and organizing. It does not process, facilitate, or intermediate any financial transactions. All financial settlements between users occur outside of the App and are solely the responsibility of the parties involved.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. You are responsible for ensuring that your use of the App complies with all applicable laws and regulations in your jurisdiction.

4. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized access to your account

5. Subscription Plans and Billing

Free and Paid Tiers

Booki offers a free tier with limited features and a paid subscription tier ("Booki Pro") with expanded capabilities. The specific features and limits of each tier are described on our pricing page and within the App, and may change from time to time.

Billing

Booki Pro is billed as a recurring monthly subscription at the price displayed at the time of purchase. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Prices are in US dollars and do not include applicable taxes, which may be added at checkout based on your location.

Free Trial

We may offer free trials of Booki Pro at our discretion. If you do not cancel before the trial period ends, your payment method will be charged for the subscription. Trial eligibility is limited to one per account.

Cancellation

You may cancel your subscription at any time through the Stripe customer portal accessible from the App's Settings. Upon cancellation:

  • Your Pro features will remain active until the end of your current billing period
  • Your account will revert to the free tier at the end of the billing period
  • Your data will be preserved — no picks, history, or member data will be deleted
  • If your usage exceeds free-tier limits (e.g., number of members), you will not lose existing data but may be unable to add new members until you are within limits

Refunds

Subscription fees are generally non-refundable. If you believe you were charged in error or have extenuating circumstances, contact us at support@bookisports.com and we will review your request on a case-by-case basis.

Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

6. Acceptable Use

You agree to use the App only for its intended purpose as a social scorekeeping tool. You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Use the App to operate or facilitate a commercial gambling operation
  • Attempt to gain unauthorized access to any part of the App or its systems
  • Interfere with or disrupt the App's infrastructure or other users' access
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems (bots, scrapers) to access the App
  • Impersonate another person or misrepresent your identity
  • Upload or transmit viruses, malware, or other harmful code

7. User Content

You retain ownership of any content you create within the App (group names, member names, notes, etc.). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service. We do not claim ownership of your data and will not use it for purposes unrelated to the App.

8. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is owned by Booki and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App or its content without our prior written consent.

9. Sports Data

The App displays sports data including schedules, scores, and odds sourced from third-party providers. This data is provided "as is" for informational purposes only. We make no guarantees regarding the accuracy, completeness, or timeliness of sports data. You should not rely solely on data displayed in the App for any decision-making.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Booki and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another party.

13. Financial Disclaimer

Booki is a record-keeping tool only. The App does not:

  • Process, hold, or transfer any money or funds between users
  • Act as a payment processor or financial intermediary for user-to-user transactions
  • Provide financial, legal, or gambling advice
  • Guarantee or insure any transactions between users

Subscription payments for Booki Pro are processed by Stripe and are separate from any financial arrangements between users. Any financial arrangements between users are private matters between those individuals. Booki bears no responsibility for debts, disputes, or settlements between users. Users are solely responsible for ensuring their activities comply with applicable laws in their jurisdiction.

14. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. If you have an active paid subscription and we terminate your account without cause, we will provide a pro-rated refund for the unused portion of your billing period. You may delete your account at any time through the App settings. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination will remain in effect.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Los Angeles County, California.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Booki regarding the use of the App, and supersede any prior agreements between you and Booki relating to the App.
